Terms and Conditions
1. Scope of application
For all orders via our online shop the following terms and conditions apply.
Our online shop is directed exclusively at consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity can be attributed. Entrepreneur is a natural or legal person or a partnership with legal capacity, which acts in exercise of its commercial or independent professional activity when concluding a legal transaction.
2. Contract partner, conclusion of contract, correction option
The purchase contract is concluded with the Pukka Berlin GmbH. By placing the products in the online shop we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained in the order process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after sending the order you will receive another confirmation by e-mail.
3. Contract language, contract text storage
The languages available for the conclusion of the contract are German and English. We save the text of the contract and send you the order data and our general terms and conditions in text form. You can view the contract text in our customer login.
4. Terms of delivery
In addition to the indicated product prices, shipping costs may be incurred. You will find more detailed information about possible shipping costs for your region in the offers. You have the possibility to pick up your order in our store: Pukka Berlin GmbH, Budapester Str. 48, 10787 Berlin, Germany, during the following business hours: 10am to 8pm form Monday to Saturday.
5. Payment
In our shop the following payment methods are basically available to you:
Credit card
When you place your order you provide your credit card details. After your legitimation as a legitimate cardholder, the payment transaction will be carried out automatically and your card will be charged.
PayPal
During the ordering process you will be redirected to the website of the online provider PayPal. In order to pay the invoice amount via PayPal, you must be registered there or register first, authenticate with your access data and confirm the payment order to us. After placing the order in the shop, we will ask PayPal to initiate the payment transaction. The payment transaction will be carried out automatically by PayPal immediately afterwards. You will receive further instructions during the ordering process.
PayPal Plus
Within the payment service PayPal Plus we offer you different payment methods as PayPal Services. You will be forwarded to the website of the online provider PayPal. There you can enter your payment data, confirm the use of your data by PayPal and the payment order to PayPal. If you have chosen PayPal as your payment method, you must be registered there or register first in order to be able to pay the invoice amount and authenticate yourself with your access data. The payment transaction is automatically carried out by PayPal immediately after confirmation of the payment order. You will receive further information during the ordering process. If you have chosen the credit card payment method, you do not need to be registered with PayPal to be able to pay the invoice amount. Immediately after confirmation of the payment order and after you have been identified as the legitimate cardholder, the payment transaction will be processed by your credit card company at the request of PayPal and your card will be charged. You will receive further information during the ordering process. If you have chosen the payment method direct debit, you do not need to be registered with PayPal to pay the invoice amount. When you confirm the payment order, you give PayPal a direct debit mandate. PayPal will inform you about the date of the debit (so-called prenotification). By submitting the direct debit mandate immediately after confirmation of the payment order, PayPal requests its bank to initiate the payment transaction. The payment transaction is executed and your account is debited. You will receive further instructions during the ordering process.
Sofort by klarna
After placing the order, you will be redirected to the website of the online provider Sofort GmbH. In order to be able to pay the invoice amount via Sofort, you must have a bank account that is activated for online banking, identify yourself accordingly and confirm the payment order to us. You will receive further instructions during the ordering process. The payment transaction will be carried out immediately afterwards by Sofort and your account will be debited.
Apple Pay
In order to pay the invoice amount via Apple Pay, you must use the “Safari” browser, with which service provider Apple is registered, have activated the Apple Pay function, identify yourself with your access data and confirm the payment order. The payment transaction will be carried out immediately after the order is placed. You will receive further instructions during the ordering process.
Giropay
After placing the order you will be redirected to the website of your bank. In order to be able to pay the invoice amount via Giropay, you must have a bank account activated for online banking, you must identify yourself accordingly and confirm the payment order to us. You will receive further instructions during the ordering process. The payment transaction is carried out immediately afterwards and your account is debited.
Purchase through invoice with Klarna
In cooperation with Klarna AB (www.klarna.de), Sveavägen 46, Stockholm, Sweden, we offer invoice purchase as a payment option. Please note that Klarna Invoice is only available for consumers and that payment must be made to Klarna in each case. When buying on account with Klarna, you will always receive the goods first and you always have 14 days to pay. The complete terms and conditions for purchase on account can be found here.
Purchase through invoice or instalment with Klarna
In cooperation with Klarna AB (www.klarna.de), Sveavägen 46, Stockholm, Sweden, we offer invoice purchase and instalment purchase as a payment option. Please note that Klarna Invoice and Klarna Instalment Purchase are only available for consumers and that payment must be made to Klarna in each case.
Klarna instalment purchase
With Klarna’s financing service you can pay for your purchase flexibly in monthly instalments of at least 1/24 of the total amount (but at least € 6.95). 6. Transport damages
If goods with obvious transport damages are delivered, please complain about such errors as soon as possible to the deliverer and please contact us immediately. Failure to make a complaint or contact us will have no consequences for your legal claims and their enforcement, especially your warranty rights. However, you help us to be able to assert our own claims against the carrier or the transport insurance.
7. Warranties and guarantees
The statutory law on liability for defects shall apply. Information on any additional warranties and their exact conditions can be found with the product and on special information pages in the online shop.

8. Liability
For claims based on damages caused by us, our legal representatives or vicarious agents, we are always liable without limitation
- in case of injury to life, body or health
- in case of intentional or grossly negligent breach of duty
- in the case of guarantee promises, if agreed, or
- as far as the scope of application of the product liability law is opened.
In the event of a breach of material contractual obligations, the fulfilment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, on the part of our legal representatives or vicarious agents, liability shall be limited in amount to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected. Otherwise claims for damages are excluded.
9. Settlement of disputes
The European Commission provides an Online Dispute Resolution (OS) platform, which you can find here. We are neither obliged nor prepared to participate in dispute resolution proceedings before a consumer dispute resolution agency.
